Welcome to Lux Notary Co. These Terms of Service (“Terms”) govern your use of the Lux Notary Co website and the services provided by Lux Notary Co and its commissioned Notaries Public and Notary Signing Agents.

By accessing our website, scheduling an appointment, requesting services, submitting a service request, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.

1. SERVICES

 

Lux Notary Co provides professional notarial and related services, which may include:

• General Notarizations

• In-Office Notary Services

• Mobile Notary Services

• Real Estate and Loan Signings

• Apostille and Authentication Assistance

• Document Printing and Scanning

• Conference Room Reservations

• After-Hours Notary Services

• Hospital, Nursing Home and Assisted Living Facility Appointments

• Detention Facility and Jail Appointments

• Other document-related services as offered

Services are subject to Notary availability, document eligibility, applicable law, location, and individual circumstances.

2. NOTARY PUBLIC SERVICES

 

All notarizations are performed in accordance with applicable Virginia law.

The Notary Public must be able to satisfactorily identify the signer and determine that the signer is appearing willingly and is able to communicate directly with the Notary.

A Notary may decline or discontinue a notarization when permitted or required by law, including when satisfactory identification cannot be established, the signer is unwilling to sign, the Notary has reason to believe the transaction may be unlawful, or another circumstance prevents the Notary from lawfully completing the requested act.

Payment for travel, printing, waiting time, after-hours service, or other services already provided may still be due even when a notarization cannot be completed.

3. IDENTIFICATION REQUIREMENTS

 

Clients are responsible for having acceptable identification available at the time of the appointment when identification is required.

 

Clients are encouraged to confirm identification requirements before their scheduled appointment.

 

Failure to provide satisfactory identification may result in the appointment being canceled or the notarization being declined.

 

4. DOCUMENT RESPONSIBILITY

 

Clients are responsible for providing their own documents and ensuring that documents are complete and ready for notarization.

 

Unless otherwise permitted by law, Lux Notary Co and its Notaries Public do not select documents, determine which documents a client needs, prepare legal documents, provide legal interpretations, or advise a client which type of notarial act should be performed.

 

Clients should contact the document's issuing agency, receiving agency, attorney, title company, lender, or other appropriate professional if they have questions regarding how a document should be completed or which notarial act is required.

 

5. NOT LEGAL ADVICE

 

Lux Notary Co is not a law firm.

 

Unless an individual providing a separate service is independently licensed to practice law, Lux Notary Co and its Notaries Public do not provide legal advice or legal representation.

 

A Notary Public cannot provide advice concerning the legal effect of a document, determine whether a document is appropriate for a client's circumstances, or otherwise perform services that constitute the unauthorized practice of law.

 

Clients requiring legal advice should consult a licensed attorney.

 

6. FEES

 

Notarial fees are charged in accordance with applicable Virginia law.

 

Additional fees may apply for services separate from the notarial act, including but not limited to:

• Mobile travel

• After-hours appointments

• Rush or same-day appointments

• Printing

• Scanning and scanbacks

• Waiting time

• Additional locations

• Conference room reservations

• Apostille coordination

• Courier or shipping services

• Document retrieval

• Other administrative or convenience services

 

Applicable fees will be disclosed prior to confirmation of the service whenever reasonably practicable.

Prices published on our website are subject to change.

 

7. MOBILE NOTARY APPOINTMENTS

 

Mobile service fees are separate from fees charged for the notarial act.

 

Travel fees may vary based on location, distance, travel time, appointment time, parking requirements, tolls, facility requirements, and other circumstances.

 

Clients are responsible for providing an accurate service address when scheduling.

 

Additional charges may apply if the Notary is required to travel to an additional location or if the location changes after the appointment has been confirmed.

 

8. AFTER-HOURS SERVICES

 

Appointments scheduled outside Lux Notary Co's regular business hours may be subject to an after-hours fee.

Availability of after-hours or 24-hour mobile services is not guaranteed and depends upon Notary availability.

Emergency, overnight, holiday, hospital, detention facility, and other specialized appointments may require additional fees.

 

9. HOSPITAL, HEALTHCARE & CARE FACILITY APPOINTMENTS

 

For appointments at hospitals, nursing homes, assisted living facilities, rehabilitation centers, hospice facilities, and similar locations, the signer must be available and able to participate in the notarization when the Notary arrives.

Facility policies, medical circumstances, visitor restrictions, availability of witnesses, or other circumstances outside Lux

 

Notary Co's control may prevent an appointment from being completed.

 

Lux Notary Co does not make medical or legal determinations regarding a person's capacity to execute a document.

 

10. DETENTION FACILITY & JAIL APPOINTMENTS

 

Detention facility appointments are subject to the policies, schedules, security procedures, and visitation requirements of the applicable facility.

 

Lux Notary Co cannot guarantee access to an inmate or completion of a notarization after arriving at a facility.

 

Travel, waiting, parking, and other applicable service fees may remain due when an appointment cannot be completed because of circumstances outside the Notary's control.

 

11. REAL ESTATE & LOAN SIGNINGS

 

Lux Notary Co provides professional real estate signing services for title companies, escrow companies, lenders, attorneys, signing services, real estate professionals, and private clients.

 

Notary Signing Agents facilitate the execution and notarization of documents as instructed by the hiring party.

 

Notary Signing Agents do not provide borrowers or signers with legal, financial, lending, tax, or real estate advice.

 

Questions concerning loan terms, interest rates, fees, settlement figures, document contents, or the transaction itself must be directed to the lender, title company, attorney, settlement agent, or other appropriate party.

 

12. SCANBACK SERVICES

 

When scanback service is purchased for an eligible real estate signing, Lux Notary Co's standard service goal is to electronically return completed documents within 45 minutes following completion of the signing and final document review.

 

The 45-minute period does not begin at the scheduled appointment time.

 

Turnaround may be affected by document volume, equipment or internet failures, severe weather, emergencies, receiving-party system issues, or other circumstances outside Lux Notary Co's reasonable control.

 

13. SIGNER / BORROWER COPIES

 

When requested or required, printed signer or borrower copies may be subject to a per-page printing fee.

 

The hiring company or requesting party is responsible for advising Lux Notary Co whether a complete printed signer copy is required when placing the assignment.

 

14. APOSTILLE & AUTHENTICATION SERVICES

 

Lux Notary Co provides apostille and document authentication assistance and coordination services.

 

Lux Notary Co does not issue apostilles or governmental authentications.

 

Apostilles and authentications are issued exclusively by the appropriate governmental authority.

 

Government fees, shipping charges, courier expenses, translation services, document retrieval charges, embassy or consular fees, and other third-party expenses are separate from Lux Notary Co's service fees unless expressly stated otherwise.

 

Lux Notary Co cannot guarantee that a document will qualify for authentication until it has been reviewed.

Government processing times are outside the control of Lux Notary Co and are not guaranteed.

 

Lux Notary Co is not affiliated with the Virginia Secretary of the Commonwealth, the U.S. Department of State, any foreign embassy or consulate, or any other governmental agency.

 

15. CONFERENCE ROOM RESERVATIONS

 

Lux Notary Co conference rooms may be available by reservation for notary appointments, real estate closings, document signings, client meetings, and approved professional uses.

 

Reservations are subject to availability and applicable reservation policies.

 

Individuals reserving conference rooms are responsible for their conduct and the conduct of their guests and must leave the room in substantially the same condition in which it was provided.

 

Lux Notary Co reserves the right to refuse or discontinue use of its facilities for unlawful, unsafe, disruptive, or unauthorized activities.

 

16. APPOINTMENT TIMES & WAITING

 

Lux Notary Co makes reasonable efforts to arrive and begin services at the scheduled time.

 

Appointment times may be affected by traffic, weather, prior appointments, facility procedures, emergencies, or circumstances outside our reasonable control.

 

Clients should be prepared and available at the scheduled appointment time.

 

Applicable waiting-time fees may be assessed when a Notary is required to wait beyond the complimentary waiting period disclosed at booking.

 

17. CANCELLATIONS & NO-SHOWS

 

Cancellation, no-show, travel, and related fees may apply depending upon the service requested.

 

A client may be responsible for applicable fees when:

• An appointment is canceled after a Notary has begun traveling;

• The signer is unavailable;

• The signer fails to appear;

• Required identification is unavailable;

• Required documents are unavailable;

• The service address provided is incorrect;

• Facility access cannot be obtained;

• The Notary is required to wait beyond the included waiting period; or

• The notarization cannot be completed for reasons outside the Notary's control.

 

Any applicable cancellation policy presented during booking or confirmation is incorporated into these Terms.

 

18. PAYMENT

 

Payment is due according to the terms provided when the service is scheduled.

 

Lux Notary Co may require advance payment, a deposit, card authorization, or payment upon completion depending upon the service.

 

Clients are responsible for all agreed service fees, applicable taxes, government fees, shipping charges, and authorized third-party expenses.

 

19. NO GUARANTEE OF DOCUMENT ACCEPTANCE

 

Completion of a notarization does not guarantee that a document will be accepted by a court, government agency, lender, title company, foreign government, financial institution, or other receiving party.

 

Lux Notary Co is not responsible for rejection caused by the document itself, instructions supplied by another party, incorrect or incomplete information provided by the client, requirements not disclosed to Lux Notary Co, or requirements imposed after the notarization.

 

20. INDEPENDENT CONTRACTOR NOTARIES

 

Lux Notary Co may utilize qualified independent contractor Notaries Public and Notary Signing Agents to fulfill certain service requests.

 

Notaries are responsible for maintaining their own active commissions and complying with applicable laws and professional requirements.

 

Assignment of a particular Notary is not guaranteed unless expressly confirmed.

 

21. WEBSITE INFORMATION

 

Lux Notary Co makes reasonable efforts to maintain accurate information on its website. However, services, availability, pricing, service areas, policies, and other information may be modified from time to time.

 

Website content is provided for general informational purposes and should not be interpreted as legal advice.

 

22. PRIVACY & CONFIDENTIALITY

 

Lux Notary Co recognizes the sensitive nature of documents handled during notarial and signing services and takes reasonable measures to protect client information.

 

Information may be disclosed when necessary to complete a requested service, comply with applicable law, fulfill instructions from an authorized hiring party, or respond to a valid legal requirement.

 

Our collection and use of information through the website may also be governed by our separate Privacy Policy.

 

23. LIMITATION OF LIABILITY

 

To the fullest extent permitted by applicable law, Lux Notary Co shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from circumstances outside its reasonable control.

 

Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited under applicable law.

 

24. FORCE MAJEURE

 

Lux Notary Co shall not be responsible for delays or inability to provide services caused by circumstances beyond its reasonable control, including severe weather, natural disasters, power outages, internet or technology failures, government closures, transportation disruptions, facility restrictions, emergencies, or similar events.

 

25. RIGHT TO REFUSE SERVICE

 

Lux Notary Co and its Notaries Public reserve the right to decline or discontinue a service when permitted by law, including when a request is unlawful, unsafe, fraudulent, threatening, abusive, outside the scope of the Notary's authority, or cannot lawfully or ethically be completed.

 

Nothing in these Terms authorizes unlawful discrimination or the refusal of a lawful notarial act on a basis prohibited by applicable law.

 

26. GOVERNING LAW

 

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

 

27. CHANGES TO THESE TERMS

 

Lux Notary Co may revise these Terms from time to time.

 

The updated version will be posted on our website with a revised effective date. Continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
